General terms and conditions for Instagram/Facebook sweepstakes of

coliro GmbH, Eppeleinstr. 5, 92353 Postbauer-Heng, Germany called coliro.

hereinafter referred to as "Organizer".

1. Subject matter

These Terms and Conditions of Participation apply to all sweepstakes conducted by coliro on the Instagram page instagram.com/colirocolors or facebook.com/colirocolors.
The Sweepstakes are in no way affiliated with Instagram/Facebook and are in no way sponsored, endorsed or organized by Instagram/Facebook. The recipient of the data provided by the participants is not Instagram, but coliro GmbH. All information within the scope of the sweepstakes is provided exclusively by coliro GmbH as the organizer.

2. Participation

By participating in the sweepstakes, the Instagram user expressly acknowledges these general conditions of participation. In the event of a breach of the conditions of participation, the participant* will be excluded from the competition.
All persons who are at least 14 years old at the time of participation and have their current residence in Germany, in another country of the European Union, the U.S.A. or another country are eligible to participate. Neither costs nor the purchase of goods or services are associated with participation in a prize draw. The prizes offered are listed in the respective description of the sweepstakes. Payment in cash or exchange of the prizes is excluded. Winnings may also not be transferred to third parties. If a prize offered at the beginning of the competition is no longer available at the end of the competition, the organizer will determine an equivalent replacement.
Participation is only possible via a personal Instagram/Facebook registration (an own Instagram/Facebook account).
The start of the competition is the date of publication on the Instagram/Facebook page instagram.com/colirocolors or facebook.com/colirocolors. Participation is only possible until the respective specified time. Corresponding times (in CET or CEST) can be found in the details of the competition on the Instagram page.
Depending on the competition, participation is possible by liking a post on our Instagram/Facebook page, commenting on it or writing a message to coliro GmbH as the operator of the Instagram/Facebook page. The specific actions required in each case to participate in a competition on the Instagram/Facebook page can be found in the description of the competition in the feed of the Instagram/Facebook page.
Participation after the expiry of the specified deadline for offering the prize is excluded. The electronically logged receipt by the organizer is decisive. The organizer cannot be held responsible for any technical malfunctions, e.g. any telephone network failures or server malfunctions, which prevent timely participation.
The organizer reserves the right to change the sweepstakes components due to unforeseen circumstances without prior notice, to cancel or terminate the sweepstakes. The latter applies in particular if software or hardware errors occur and/or the proper execution of the competition is no longer possible due to other technical or legal reasons.

3. Contents

The organizer is not liable for content uploaded on the Instagram pages of the participants. In this respect, the participant fully indemnifies the organizer from all claims of third parties, including the necessary costs of legal defense and prosecution.

4. Winnings / prize determination

The prize will be stated in the respective competition posting and can be taken from the Instagram page instagram.com/colirocolors. Only non-cash prizes are offered, the payment or exchange of which is excluded. The right to win is not transferable.
Determination/acceptance of the prize: The winner will be determined by drawing lots, unless otherwise stated in the Instagram post. A random number generator will determine the winner from all participants.
If the posting of own content for the purpose of participation is not required, but the participation action consists only, for example, that a post is to be "liked" or a question is to be answered, the random principle decides. The winners will be determined immediately after the end of the competition and notified via Instagram. If a winner does not get in touch within two weeks after notification, the prize will be forfeited and a replacement winner will be determined.
The winner must demonstrably confirm acceptance of the prize within a period specified in the prize notification (by e-mail / Instagram message). As a rule, the prize will be delivered by mail or e-mail, therefore, the winner must provide his full contact details including postal address and e-mail address in the event of notification. The legal process is excluded.

5. Liability

Insofar as the non-cash prize involves offers from third parties, coliro GmbH shall not be liable for non-performance or poor performance or for any damage suffered by the winner on the occasion of the use of the service. The respective terms and conditions of the prize sponsors apply; any warranty claims or claims for damages must be addressed to them.

As the organizer of the prize draw, coliro GmbH shall only be liable for damages in connection with the prize draw that were caused intentionally or by gross negligence by employees of the company. As the prize provider, the organizer shall not be liable for damages due to malfunctions of technical equipment, for delays or interruptions of transmissions or for damages in connection with participation in the prize draw.

6. Data protection

For the purpose of processing the prize draw, personal data will be collected from the winner and any accompanying persons. In the event of a win, the organizer is entitled to publish the Instagram profile picture and the name of the winner on Instagram as well as on the website coliro.de. By participating in an Instagram competition of coliro GmbH on instagram.com/colirocolors, each participant agrees to these data protection guidelines.

Since the protection of our participants* personal data is very important to us, we provide information in our separate privacy policy on our website https://coliro.de/shop/en/gtc about the type, scope and purpose of the data collection and use that we comply with in the context of contacting us, registering or participating in an event, participating in sweepstakes via Facebook and Instagram or in the context of another service promise.

7. Other

By participating in our sweepstakes, participants release Instagram/Facebook from any liability. The law of the Federal Republic of Germany is exclusively applicable. Should any of these conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected (severability clause). Legal recourse is excluded. These conditions of participation may be amended by coliro GmbH at any time. We reserve the right to cancel or terminate the competition at any time.
